A. TERMS AND CONDITIONS OF PARTICIPATION

 
1. Organizer
The competition is organized by Georg Neumann GmbH, Leipziger Straße 112, 10117 Berlin (organizer).
 
2. Authorized participants
All persons of legal age are entitled to participate. Employees of the organizer or companies contracted by the organizer and their relatives are excluded from participating. A person can only participate once. Repeated participation will lead to exclusion from the group of persons entitled to participate.
 
The organizer reserves the right to exclude participants from the competition who violate the conditions of participation or common decency and/or otherwise attempt to influence the draw in an unfair and/or dishonest manner.
 
3. Process
Participation is only open to visitors to Neumann Superbooth in Berlin from 8th to the 10th of May. Participants must answer the question on the raffle tickets by ticking the correct answer and provide their full name, email address and telephone number. They must also agree to the terms and conditions and privacy policy described here. The ticket must then be placed in the box provided.
 
 
4. Procedure for determining the winner
The winner will be determined by lot at the end of the participation period. There is no right of appeal.
 
The winner will be informed of the win afterwards. The winner agrees to be contacted via their phone number in the event of a win. The winner must pick up the prize at Neumann. The prize will be forfeited if the winner does not show up and cannot be reached by phone. In this case, a new winner will be drawn. It is not possible to pay out the value of the prize in cash. The prize cannot be transferred to third parties. 
 
5. Prize
The prize is a pair of Neumann KH 120 II studio monitors.
6. No dependency on payments
Participation in the draw is not subject to a purchase or payment to the organizer. A purchase or payment has no influence on the chances of winning.
 
7. Data protection
As part of the competition, personal data will be processed in accordance with the data protection notice below (see B.).
 
8. Acceptance of the conditions of entry
By entering the competition, the participant agrees to the terms and conditions.
 
9. Liability
The organizer is liable for intent and gross negligence. For slight negligence, he is only liable for breach of an essential contractual obligation (cardinal obligation), the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the participant may regularly rely, as well as for damages resulting from injury to life, limb or health.
 
10. Premature termination or interruption
The organizer reserves the right to interrupt or prematurely terminate the competition if there is good cause to do so. In particular, compelling legal reasons, such as official orders, changes in legislation or other reasons for refusing to hold the competition, shall be deemed good cause.
 
11. Applicable law, place of jurisdiction; severability clause
The law of the Federal Republic of Germany shall apply to any disputes arising out of or in connection with the competition described above, excluding the conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these conditions of entry is Hannover. Should any of the clauses of this agreement be or become invalid, the validity of the remaining agreement shall not be affected.
 
 
 
B. DATA PRIVACY STATEMENTS
 
The following personal data may be processed by Georg Neumann GmbH, Leipziger Straße 112, 10117 Berlin, Germany, in connection with the competition:
· Master data (e.g. first name, last name)
· Address data (e.g. street, postal code)
· Contact data (e.g. telephone number, e-mail address)
· individual data in connection with the respective competition, in particular Instagram username.
 
The processing is carried out on the basis of the execution and fulfillment of the contractual purposes arising from the competition (Art. 6 para. 1 lit. b) GDPR). If personal data of the winner is published on the Instagram profile of Georg Neumann GmbH, this will only be done with the explicit consent of the winner, obtained in advance, in accordance with Art. 6 (1) point a GDPR.
 
The data collected from the participant will be used by the organizer exclusively for the purpose of conducting the competition, in particular for determining and notifying the winner and for sending the prizes.
 
The personal data will not be used for any purpose beyond that described here, nor will it be passed on to third parties. In particular, the data collected will not be used for other marketing purposes.
 
The participant's personal data will be deleted as soon as the purpose for which it was processed has been achieved. Due to legal requirements, different retention periods may apply.
As the data subject, participants have the following additional rights in relation to Georg Neumann GmbH:
Right of access – The right to know which data is processed and how.
Right to rectification – The right to request the correction of inaccurate or outdated personal data.
Right to erasure – The right to have personal data deleted.
Right to restriction of processing – The right to restrict data processing.
Right to data portability – The right to transfer personal data directly from one system to another (in machine-readable form).
Right to object – Under the conditions set forth in Art. 21 GDPR, subscribers have the right to object to data processing at any time.
